SongBox FUN Terms of Service

1. General provisions

1.1. These Terms of Service (the "Terms") govern the use of the SongBox FUN online service — the Telegram bot @SongBox_AI_bot and its website (the "Service") provided by SongBox FUN Service Administration (the "Administration").

1.2. By using the Service — including starting the bot, paying for services or receiving songs — the User confirms that they have read these Terms and the Privacy Policy (/privacy command) in full and accept them.

1.3. If the User does not agree with these Terms, they must stop using the Service.

1.4. The Service is intended only for persons aged 18 or over. By using the Service, the User confirms that they are at least 18 years old.

1.5. If the Administration learns that a person under 18 is using the Service, it may restrict access and delete the data of that account.

2. Nature of the services and digital goods

2.1. The Service provides digital goods and intangible services: creating a personal song (lyrics and an audio recording) with artificial intelligence technology, based on the User's answers and story or on lyrics the User sent themselves.

2.2. How the Service works:

  • the User answers questions (who the song is for, the occasion, genre, style, mood, vocals, song language, their story) or sends their own lyrics;
  • the Service prepares the lyrics, which the User can review and ask to change;
  • after confirmation the Service creates the music; this usually takes a few minutes;
  • the song is delivered to the chat with the bot and is available under "My songs".

2.3. The unit of payment is a "song" (credit). One song on the balance entitles the User to one full version of a song (for one request the Service may deliver several performance variants — all of them are part of that one song). Songs are bought in packs; current packs and prices are shown by the /prices command and in the "Balance" section before payment.

2.4. When payments are available, each User gets 1 free song creation over the whole time they use the Service; it produces a preview clip of up to 30 seconds. The full version costs one song from the balance.

2.5. Demo mode. The Service may run in demo mode, in which no payments are taken and songs are created free of charge within a limit set by the Administration. The current mode, limits and whether payments are available are shown in the bot (/prices command) and on the Service's website. The payment and refund provisions of section 7 apply to purchases made when payments are available.

2.6. Languages. The Service works in Russian and English. The interface language is chosen automatically from the language set in Telegram (Russian for a Russian Telegram language, English for all others) and can be changed at any time with the "🌍 Language" button in the bot menu. The User chooses the song language when creating a song.

2.7. Each song is created anew at the User's request. The User understands and agrees that the output of artificial intelligence cannot be precisely predicted in advance: sound, melody, performance and meeting expectations are not guaranteed. The Service does not claim or guarantee that individual elements of a song (melodic phrases, chords, lines) are unique; similar elements may appear in songs created for other users.

3. Disclaimer of warranties and liability

3.1. The Service is provided "AS IS".

3.2. The Administration does not guarantee:

  • that the result matches the User's artistic expectations;
  • any financial, commercial, professional or other results;
  • uninterrupted and error-free operation of the Service.

3.3. The Administration is not liable for:

  • any direct or indirect losses, including lost profits;
  • the consequences of the User's use of the songs received;
  • acts or omissions of third parties, including Telegram, payment systems and technology providers;
  • temporary technical failures and access restrictions.

3.4. All decisions about using songs are made by the User independently and at their own risk, within the licence set out in section 5.

4. Lawful use, content rules and moderation

4.1. The Service is not intended to encourage, organise or facilitate unlawful activity.

4.2. The User undertakes to use the Service only in accordance with applicable law and the rules of third parties (including Telegram's rules).

4.3. The User is solely responsible for the content of their requests (answers, story, own lyrics). The User may not include other people's personal data in requests without their consent, or send lyrics they have no rights to.

4.4. The Service always refuses, regardless of any settings, requests that contain or ask for:

  • sexual content involving minors, or any sexualisation of children;
  • instructions for making weapons, explosives, ammunition or other means of harm.

4.5. The following are also not allowed — requests that contain or ask for:

  • explicit sexual content (romantic and tender songs for a loved one are fine);
  • incitement of hatred or hostility, calls for violence, discrimination on the basis of race, ethnicity, religion, sex, orientation or other characteristics;
  • encouragement of self-harm or suicide;
  • imitation of the voice, style or persona of real named artists, impersonation of another real person, or use of other people's songs and lyrics the User has no rights to;
  • promotion of drugs, or instructions for making or obtaining them;
  • fraud, deception, threats or harassment;
  • any other content prohibited by law or by Telegram's rules.

4.6. Moderation. Requests and the final lyrics are checked by automated systems, including artificial-intelligence classifiers, before the music is created and before a song is debited from the balance. Moderation may refuse a request, including in borderline cases. No song is debited for a request refused by moderation, and the free creation is not used up — the User can change the request and try again. If the User believes a refusal was a mistake, they can contact support (section 10).

4.7. Temporary restriction. If moderation refuses 3 of the User's requests under the content rules within 24 hours, creating new songs is temporarily restricted for about 24 h. After the second-to-last such refusal the bot warns the User about the possible restriction. The restriction lifts automatically; the rest of the Service (balance, "My songs", support) stays available.

4.8. If the lyrics written by artificial intelligence break the rules while the User's request does not, creation of the song stops, but this is not counted as the User's violation and does not count towards clause 4.7 — the User can try again.

4.9. Serious or systematic attempts to get around the content rules may lead to access being restricted under section 6.

5. Rights to songs and intellectual property

5.1. Once the full version of a song is received, the User is granted a simple (non-exclusive) licence for personal, non-commercial use of the song, with no time limit: listening, giving it as a gift, playing and showing it among family and friends, at private celebrations, and posting it on personal social-media accounts without monetisation.

5.2. The licence does not include commercial use: selling, publishing on streaming platforms and music stores, monetisation, use in advertising, in commercial videos, on air, in public venues, registering the song in content-recognition systems (Content ID and similar), or transferring rights to third parties.

5.3. The preview clip is provided only to evaluate the song and may also be used only for personal, non-commercial purposes.

5.4. Lyrics the User wrote themselves remain their own. The User warrants that they hold the rights to lyrics they send and that using them does not infringe third-party rights.

5.5. The software, design, texts and other materials of the Service are protected by intellectual-property law. The User may not copy, distribute, resell or otherwise use the Service's materials without the rights holder's permission.

5.6. Breaching the licence terms or intellectual-property rights may result in restricted access to the Service without compensation.

6. Restriction of access

6.1. The Administration may suspend or restrict the User's access to the Service in the event of:

  • a breach of these Terms, including the content rules (section 4);
  • detected abuse (including creating multiple accounts to obtain free songs or bonuses);
  • a chargeback initiated in breach of clause 7.11;
  • requirements of law or of payment providers.

6.2. Restriction of access does not release the User from obligations that arose earlier.

6.3. The Administration reserves the right to refuse service to Users whose actions may create heightened risks for the Service, payment providers or third parties.

7. Payments and refunds

7.1. When payments are available, they are made at the prices and on the terms shown in the Service before payment (/prices command, "Balance" section). Payments are accepted through SBP (the Russian Faster Payments System; the payment is processed by a payment system, prices in roubles), with crypto (the payment is processed by a payment system, prices in US dollars) and through Telegram Stars (prices in Stars).

7.2. Before the first purchase the User confirms in the bot that they have read and accept these Terms.

7.3. The Service shows the pack price. When paying via SBP or with crypto, the payment system adds its fee to the price, which the User pays; the final amount including the fee is shown on the payment page before the payment is confirmed. With Telegram Stars the User pays exactly the number of Stars shown; the cost of buying Telegram Stars themselves is set by Telegram. Every purchase is one-off; there are no subscriptions or automatic charges.

7.4. The digital goods are provided immediately: songs are credited to the balance as soon as the payment system confirms the payment.

7.5. Failed song creation. If creating a full version did not complete successfully for a technical reason, the debited song is automatically returned to the balance — there is no need to contact support.

7.6. Because digital goods and services are intangible, no money is refunded once access has been provided, except in the cases listed in clause 7.7. Crediting songs to the balance constitutes providing access.

7.7. A money refund is possible only if:

  • the service was not provided through the Service's technical fault and was not made good under clause 7.5;
  • access to the digital goods was not actually provided (songs were not credited after payment).

To have a refund considered, the User must contact support within 24 hours of payment.

7.8. The free song creation and songs received free of charge (bonuses, the referral programme, demo mode) have no cash value, cannot be exchanged for money and are not refundable.

7.9. Refunds are made by the same method as the payment (for Telegram Stars — in Stars). The Administration decides on each refund request individually.

7.10. For questions about purchases made with Telegram Stars, the User can use the /paysupport command in the bot or contact support (section 10).

7.11. The User confirms that they undertake not to initiate a chargeback through payment systems without first contacting the Service's support. If a disputed payment is returned to the User, the unused songs from that purchase are debited from the balance and access may be restricted under section 6.

8. Privacy

8.1. How data is collected, stored and deleted is described in the Privacy Policy (/privacy command and the Service's website).

8.2. The Administration takes reasonable measures to protect data but does not guarantee the absolute security of transmitted information.

9. Changes to the terms

9.1. The Administration may amend these Terms.

9.2. The current version of the Terms, with its date, is published in the Service (/terms command) and on the Service's website. The Administration announces material changes in the bot or on the website before they take effect.

9.3. Continued use of the Service means the User agrees to the updated terms. Songs already credited to the balance are used on the terms in force at the time of payment.

10.1. For any question, including payments, refunds and personal data, the User can contact support — through Telegram only:

  • Telegram: @SongBox_AI_support
  • in the bot: the /support command or the "🆘 Support" button; for payments with Telegram Stars — also the /paysupport command.

By using the Service (including starting the bot and/or entering the /start command), the User confirms that they have read these Terms and accept them in full.
